Creator Agreement

1. What this is

This Creator Agreement is between you and DigitLumin LLC, and it applies in addition to the Terms of Service from the moment your creator application is approved. Where the two conflict on a subject this agreement covers, this agreement prevails.

“You” here means the individual whose identity we verified. This agreement is personal to you and cannot be transferred.

2. Eligibility and verification

Before you can publish or earn, you must complete verification: your legal name, your date of birth, a government-issued photographic identity document front and back, and a photograph of you holding it. We review applications individually.

You must be at least 18 years old and legally able to enter this agreement where you live. We may re-verify at any time, and may suspend your account until you complete re-verification.

We may decline any application, and we do not have to say why.

3. You are independent

You are an independent contractor. This agreement does not create an employment relationship, a partnership, a joint venture, or an agency between you and DigitLumin LLC.

You decide when you work, whether to accept a call, whether to answer a message, what you offer, and what you charge. We do not direct your performance, set your hours, or require you to be available.

You are responsible for your own taxes, and for any licence, registration or insurance your own jurisdiction requires of you. We do not withhold tax. Where the law requires it, we will collect tax documentation from you — a Form W-9 if you are a United States person, or the applicable Form W-8 if you are not — and report payments to the relevant authority.

4. Your content

You keep ownership of everything you create. You grant us the licence set out in the Terms of Service so that we can host and display it on Planet, and that licence ends when the content is removed.

You are the producer of your content. That carries real obligations:

• Every person appearing in anything you upload must be at least 18 and must have given informed, documented consent to the depiction and to its publication on Planet.
• You must create and keep the records that 18 U.S.C. §2257 requires, including a government-issued identity document for every person depicted, and you must produce them to us within 5 business days of our asking.
• You must comply with the Acceptable Use Policy in everything you post, send and say on a call.

If you cannot evidence age and consent for someone in your content, do not upload it. We remove content we cannot verify, and we terminate accounts that cannot produce records.

5. Pricing, and what you earn

You set your own prices: a per-message price, a per-minute price for video calls, and a per-minute price for voice calls. You can change them whenever you like, and you can switch off incoming calls.

DigitLumin LLC retains 25% of the value of every token a fan spends with you. You earn the remaining 75%. Every figure Planet shows you — your balance, your pay period totals, your earnings from a given client — is what you earn, after our share. There is no second deduction behind it.

Replying to a fan costs you nothing. Gifts and paid messages are earned when the fan spends the token; call minutes are earned as they are billed.

6. Payouts

Earnings accrue to your balance and are paid out by pay period through the payout method you have registered with us.

• You must give accurate payout and tax details, and keep them current. We cannot pay you without them.
• A payout may be delayed where we are investigating fraud, a chargeback, or a credible policy complaint involving your account. We tell you when that happens.
• Where a fan’s payment is reversed or charged back after you have earned from it, the corresponding amount is deducted from your balance. If your balance does not cover it, the shortfall is carried against future earnings.
• Bank and transfer fees charged by the payout rail are yours.

If your account is terminated for breaching the absolute prohibitions in the Acceptable Use Policy, any unpaid balance is forfeited and no payout is made.

7. Leaving, and what happens to money you are owed

You can close your creator account at any time.

Because earnings have to be settled, a creator account is held for 30 days between the deletion request and the erase. You confirm the request with a code we email you, together with your handle and password, and you can cancel at any point during those 30 days.

Earnings you had already accrued survive the erasure as an obligation we owe you, and are paid on the next payday after it completes. Erasing your account does not erase what we owe you.

We may terminate this agreement on notice, or immediately for a breach of the Acceptable Use Policy, for failure to produce records, or where we are required to by law.

8. Conduct

In addition to the Acceptable Use Policy:

• Do not represent yourself as an employee or agent of DigitLumin LLC, or speak for us.
• Do not use another person’s identity, photographs or likeness as your own.
• Do not arrange, solicit or accept payment for any in-person meeting or sexual service.
• Do not take payment for Planet services outside Planet, or direct fans off-platform to avoid our fee.
• Do not record a fan, and do not publish anything a fan sends you.

The last of these is not negotiable. A fan’s privacy on Planet is the product, and it runs in both directions.

9. The rest

The disclaimers, limitation of liability, indemnity, arbitration, class-action waiver and governing-law sections of the Terms of Service apply to this agreement in full, and are incorporated here.

We may change this agreement. Where a change materially affects what you earn or what you owe, we give you notice before it takes effect, and continuing to use your creator account after that means you accept it.
