Planet is operated by DigitLumin LLC and these terms apply to planetjoi.com.
1. Who we are, and what this agreement is
planetjoi.com — “Planet”, “we”, “us” — is operated by DigitLumin LLC, a limited liability company organised in Wyoming, United States.
These Terms of Service are a binding contract between you and DigitLumin LLC. They govern your access to and use of Planet, whether you hold an account or not. By accessing Planet, creating an account, or spending tokens, you accept them.
These Terms incorporate our Acceptable Use Policy, Privacy Policy, Cookie Policy, Content Removal and Complaints Policy, and Copyright Policy. If you hold a creator account, the Creator Agreement also applies and prevails over these Terms where the two conflict.
If you do not accept these Terms, do not use Planet.
2. Age, and the one rule with no exception
Planet is for adults. You may not access it unless you are at least 18 years old and have reached the age of majority in the jurisdiction from which you are accessing it, whichever is higher.
This is the one rule we enforce without discretion, appeal or exception. We terminate accounts we believe to belong to a minor, we do not restore them, and we forfeit any unspent balance on them.
We may require you to verify your age or identity at any time, and may suspend access until you do. We report suspected child sexual abuse material to the National Center for Missing and Exploited Children as required by 18 U.S.C. §2258A, and we cooperate fully with any resulting investigation.
Parents and guardians: if a minor in your care has reached Planet, write to support@planetjoi.com and we will close the account and erase it.
3. Your account
You must give accurate registration information and keep it current. You are responsible for everything done through your account and for keeping your password secret.
- One person, one account. Accounts may not be shared, sold, rented or transferred.
- You must tell us promptly at support@planetjoi.com if you believe your account has been used without your permission.
- We may refuse, reclaim or rename a handle that impersonates someone, infringes a trade mark, or is chosen to deceive.
We may suspend or close an account that breaches these Terms, that we are required to close by law, or that presents a fraud or safety risk to other people using Planet.
4. Tokens and credits
Tokens are a prepaid, limited licence to use paid features on Planet. Tokens are not money, not a deposit, not a stored-value instrument, and not a cryptocurrency or security. They have no value outside Planet.
- Tokens cannot be exchanged for cash, transferred between accounts, or redeemed by anyone other than a creator earning them through Planet.
- Tokens do not expire while your account is open and in good standing.
- Once a token has been spent — on a message, a minute of a call, or a gift — the transaction is complete and the token is not refundable, except where a refund is required by law that cannot be waived.
- If your account is closed for breaching these Terms, any unspent balance is forfeited.
- If you close your account yourself, any unspent balance is forfeited. We tell you this before you confirm.
Credits are a free daily message allowance. They are a courtesy, not a purchase. They have no cash value, do not accumulate, and may be changed or withdrawn at any time.
We may change the price of any feature. A price change never applies to a token you have already spent.
5. Paying for tokens
Token purchases are processed by a third-party payment provider. We do not receive or store your full card number.
You confirm that you are authorised to use the payment method you present, and that the billing details you give are accurate. Purchases are final when the tokens reach your balance.
If you believe a charge is wrong, contact support@planetjoi.com before contacting your bank. We will investigate any billing error in good faith and refund a charge we find to be ours.
Raising a chargeback on a charge you did in fact authorise is fraud. We may suspend an account with an open chargeback, forfeit the balance on it, and decline further business with the person behind it.
6. What you are buying
Planet is a venue. Creators set their own prices, choose whether to answer, and decide what they will and will not do. We do not direct, supervise or guarantee any creator’s conduct, availability or response.
- A paid message buys delivery of your message. It does not buy a reply. A creator is under no obligation to answer, and we do not refund an unanswered message.
- A call is billed by the minute at the creator’s published rate, from the moment it connects to the moment it ends.
- A gift is a voluntary transfer with no obligation attached to it.
- Waiting in a call queue costs nothing. You are billed only while a call is actually connected.
If a call fails to connect, or drops for a technical reason, you are not billed for time you did not have. If you believe you were billed in error, write to support@planetjoi.com within 30 days.
7. Calls are private, and we cannot see them
Voice and video calls on Planet are peer-to-peer. Audio and video travel directly between the two participants and are encrypted in transit. They are never recorded, stored, transcoded or intercepted by us, and they do not pass through our servers except, where a network makes a direct connection impossible, as opaque encrypted relay traffic we cannot read.
This has a consequence worth stating plainly: we cannot produce the content of a call. Not for you, not in a data export, not in response to a subpoena, and not for our own moderation. It was never in our custody.
What we do keep about a call is metadata — who called whom, when, for how long, at what price, and whether a relay was used. That is what we bill from and what appears in your data export.
8. Recording is prohibited
You may not record, screen-capture, photograph, stream, transcribe or otherwise capture any call, message, image or video on Planet, and you may not redistribute anything you obtain here.
Recording a person without their consent is a crime in many jurisdictions, and publishing an intimate recording without consent is a crime in most. Beyond that, it is the single worst thing you can do to the people who make this platform work.
We treat a credible report of recording as grounds for immediate and permanent termination, forfeiture of any balance, and referral to law enforcement. If someone has recorded or published you, write to support@planetjoi.com — we act on those reports first, ahead of everything else.
9. Your content, and the rights you give us
You keep ownership of everything you post, send or transmit on Planet.
You grant DigitLumin LLC a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt for format and size, and display your content, solely so that we can operate, secure and improve Planet and show your content to the people you direct it to. This licence lasts only as long as we hold the content, and it ends when the content is deleted, except for copies retained in backups until they rotate out and for anything we must keep by law.
You warrant that, for everything you upload:
- you own it or have the rights to it;
- every person depicted is at least 18 years old;
- every person depicted has given informed, documented consent to the depiction and to its publication here; and
- it does not breach our Acceptable Use Policy or anyone’s rights.
We may remove content, and we may refuse to restore it. We are not obliged to store your content, and you should keep your own copies of anything that matters to you. Your data export is available at any time from your account settings.
10. Acceptable use
Our Acceptable Use Policy is part of these Terms and lists what is prohibited on Planet. Read it. The short version is that content involving anyone under 18, anyone who has not consented, or anyone being genuinely harmed is absolutely forbidden and is reported.
You also agree not to scrape, crawl, mirror or bulk-download Planet; not to circumvent our payment, rate-limiting or access controls; not to probe or attack our infrastructure; and not to use Planet to advertise, recruit for, or arrange any in-person meeting or sexual service for payment.
11. Moderation and enforcement
We may review, restrict, remove or refuse any content, and suspend or terminate any account, where we reasonably believe it breaches these Terms or the law, or presents a risk to another person.
We aim to act proportionately and to tell you what happened and why, and our Content Removal and Complaints Policy explains how to appeal. We act immediately and without notice where there is a risk to a child, a credible threat, or content published without consent.
We are not obliged to monitor content, and nothing here makes us responsible for content we have not reviewed.
12. Our intellectual property
Planet’s software, design, interface, brand and name belong to DigitLumin LLC. These Terms give you a personal, revocable, non-transferable licence to use Planet as it is offered, and nothing more. You may not copy, modify, reverse-engineer, resell or create derivative works from any part of it.
13. Disclaimers
Planet is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that Planet will be uninterrupted, secure, error-free, or that any particular creator will be available or will behave in any particular way.
You use Planet at your own risk. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.
14. Limitation of liability
To the fullest extent the law allows, neither DigitLumin LLC nor its members, officers or personnel are liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of or connected with your use of Planet, on any theory of liability, even if we were advised such damages were possible.
Our total aggregate liability to you for all claims arising out of or connected with Planet is limited to the greater of the amount you paid us in the twelve months before the event giving rise to the claim, or one hundred United States dollars.
Nothing in these Terms excludes liability for fraud, for death or personal injury caused by negligence, or for anything else that cannot lawfully be excluded. Some jurisdictions do not allow these limits, so they may not apply to you in full.
15. Indemnity
You agree to indemnify and hold harmless DigitLumin LLC and its members, officers and personnel against any claim, liability, loss or expense, including reasonable legal fees, arising out of content you provided, your use of Planet, or your breach of these Terms or of anyone’s rights.
16. Disputes, arbitration, and your right to opt out
Read this section carefully. It affects how disputes between us are resolved and limits the way you can bring a claim.
First, talk to us. Before starting any formal proceeding, send a written description of the dispute and the relief you want to support@planetjoi.com. We will do the same for you. Most things end here, and both of us agree to try for 60 days before going further.
Arbitration. If that fails, any dispute arising out of or relating to these Terms or to Planet will be resolved by binding individual arbitration administered under the rules of a recognised arbitral body, seated in Wyoming, United States, before a single arbitrator. Judgment on the award may be entered in any court of competent jurisdiction.
Individually, not as a class. Both of us waive any right to bring or take part in a class, collective, consolidated or representative action. The arbitrator may award relief only to the individual party seeking it. If this paragraph is held unenforceable as to a particular claim, that claim proceeds in court and the rest of this section still applies to every other claim.
What is carved out. Either of us may bring an individual claim in small claims court, and either of us may seek an injunction in court to protect intellectual property or to stop unauthorised access.
How to opt out. You may reject this arbitration section entirely by emailing support@planetjoi.com within 30 days of first accepting these Terms, with your handle and a clear statement that you opt out of arbitration. Opting out costs you nothing and affects nothing else. If you opt out, disputes go to the courts named in the next section.
17. Governing law and venue
These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws rules, and, where it applies, by the Federal Arbitration Act.
For any dispute not subject to arbitration, you and DigitLumin LLC submit to the exclusive jurisdiction of the state and federal courts located in Wyoming.
If you are a consumer resident in the European Union or the United Kingdom, nothing here deprives you of the protection of the mandatory laws of your country of residence, or of the right to bring proceedings there.
18. Availability where you are
We make Planet available from Wyoming, United States. We make no claim that it is lawful to access it from anywhere else, and accessing it where adult material is restricted or prohibited is your responsibility, not ours.
Some jurisdictions — including the United Kingdom and a number of states of the United States — require age assurance stronger than the confirmation we ask for at the door. Where we are subject to such a requirement we will meet it or withdraw from that market. Until we do, you must not access Planet from a place whose law you would be breaking by doing so.
19. Changes to these Terms
We may change these Terms. When we do, we change the effective date at the top and, for any change that materially affects your rights, we give notice in the product or by email before it takes effect.
Continuing to use Planet after a change takes effect means you accept it. If you do not accept it, close your account — and tell us why at support@planetjoi.com, because it is occasionally us who are wrong.
20. General
If any provision of these Terms is held unenforceable, it is severed and the rest stands. Our not enforcing a provision is not a waiver of it. You may not assign these Terms; we may assign them to a successor in connection with a merger, acquisition or sale of assets. These Terms, with the documents they incorporate, are the entire agreement between us about Planet.
